1. About these terms
SmartPrep CBSE is an assessment and learning platform owned and operated by Telique EdTech Private Limited (“SmartPrep,” “we,” “our”). By creating an account or using the service at smartprepcbse.com, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use SmartPrep.
SmartPrep CBSE is not affiliated with or endorsed by the Central Board of Secondary Education (CBSE).
2. Who can use SmartPrep
SmartPrep is built for schools. School administrators, teachers and students use it through their school. Many of our students are under 18. A student under 18 may use SmartPrep only with the authorisation of their school and with the consent of their parent or legal guardian, which the school is responsible for obtaining (see Section 3).
3. What schools are responsible for
A school that uses SmartPrep is responsible for:
- Obtaining any consent required by Indian law from the parents or guardians of its students, including under Section 9 of the Digital Personal Data Protection Act, 2023, before adding them to SmartPrep
- Giving accurate student and parent contact details, and keeping them up to date
- Choosing which SmartPrep features are switched on for its students and teachers
- The conduct of the teachers and administrators it adds to the service
4. Your account
- Give accurate information when you sign up.
- Keep your password private. You are responsible for activity under your account.
- Tell us promptly at the address in Section 11 if you think someone else has used your account.
5. Acceptable use
You agree not to:
- Access another person's account or data, or try to get around the limits of your role
- Share, copy or publish test questions or answer keys outside your class without the teacher's permission
- Use SmartPrep to cheat on an assessment, or to harass, threaten or harm anyone
- Upload content you do not have the right to use, or content that is unlawful or harmful to children
- Probe, overload or attack the service, or use it to build a competing product
We may suspend an account that breaks these rules.
6. AI features
SmartPrep uses artificial intelligence to generate questions, suggest marks and feedback, and help students study. AI can be wrong. Marks and feedback it suggests are reviewed and editable by the teacher, who is the final authority on every grade. Compass and other study tools give help, not guaranteed correct answers, and should not be the only source a student relies on. How student content is handled by AI services is explained in our Privacy Policy.
7. Your content
Worksheets, answers, uploads and other content you add remain yours (or your school's). You give us permission to store and process it, and to send it to the service providers listed in our Privacy Policy, only as needed to run SmartPrep for you. We do not sell it and we do not use student work to train AI models. SmartPrep's software, design and branding belong to us.
8. Availability and changes
We work to keep SmartPrep available and accurate, but we do not promise it will always be uninterrupted or error free. We may change or remove features. Fees, where they apply, are agreed with the school separately.
9. Ending your use
You may stop using SmartPrep at any time. A school may close its account by writing to us. We may suspend or end access for a breach of these terms. Data is handled on closing as described in our Privacy Policy.
10. Limits on our responsibility
To the extent the law allows, SmartPrep is provided “as is” and we are not liable for indirect or consequential loss, or for decisions made using AI-suggested marks or feedback. Nothing in these terms limits any right you have under Indian law that cannot be limited, including your rights under the Digital Personal Data Protection Act, 2023. These terms are governed by the laws of India.
11. Changes to these terms and contact
If we make a material change, we will update the date above and, where we can, tell school administrators. Questions about these terms, or privacy complaints, can go to us at contactus@smartprepcbse.com. Our Grievance Officer's details are in Section 14 of the Privacy Policy.
